

MIJI Family Limited Partnership, represented by attorneys Jill E. Nagy and Sean E. Summers, brought a due process claim against the Reading Area Water Authority (RAWA), alleging that RAWA failed to follow its own procedural requirements in handling MIJI’s matter. The case followed a prior decision, MMG v. RAWA, in which similar procedural deficiencies had been addressed.
In this case, RAWA acknowledged that MIJI did not receive the proper due process, attributing the lapse to administrative issues. The parties engaged in settlement discussions to resolve the dispute, recognizing that potential litigation costs and statutory fee-shifting provisions could substantially exceed the settlement amounts previously discussed.
The matter ultimately centered on efforts to reach an equitable resolution and avoid further litigation expenses.
